As of 19 May 2025, significant reforms to NSW rental legislation have commenced, impacting both landlords and tenants. These changes aim to create a fairer and more transparent rental market.
Key Changes Include:
Rent Increases: Landlords are now limited to one rent increase every 12 months, regardless of lease type.
Lease Terminations: The practice of ‘no grounds’ evictions has been abolished. Landlords must now provide a valid reason to terminate any fixed-term or periodic lease.
Notice Periods: Notice periods for ending leases have been extended. For leases of 6 months or less, a 60-day notice is required; for leases longer than 6 months, a 90-day notice is mandated.
Pet Ownership: Tenants can request to keep a pet, and landlords can only refuse for specific reasons. The pet request is automatically approved if a landlord does not respond within 21 days.
Property Standards: New requirements have been introduced to ensure rental properties meet certain water efficiency and maintenance standards.
These reforms are designed to provide greater stability for tenants while ensuring landlords have clear guidelines to manage their properties effectively.
